Terms of sale

1. General Provisions

These general conditions of sale (hereinafter, "General Conditions") apply to all sales of products (hereinafter, "Products" or "Product") purchased through the website www.truckdanet.com (hereinafter, " Site ").

The use of the distance selling service described in these General Conditions is reserved exclusively for consumers (hereinafter, "Customers" or the "Customer"), understood as natural persons acting for purposes unrelated to their commercial, entrepreneurial or professionally carried out.

The language available to conclude the contract is Italian.

The Customer is required to carefully read the General Conditions that have been made available to him on the Site, in order to allow them to be stored and reproduced by the Customer pursuant to art. 12 of the Legislative Decree 9 April 2003, n. 70.

Contracts concluded with Truckdanet s.r.l. (as defined below) through the Site are governed by Italian law and, in particular, by Legislative Decree 6 September 2005, n. 206 ("Consumer Code") and by Legislative Decree 9 April 2003, n. 70 (hereinafter, "Ecommerce Decree")

Information relating to "Truckdanet s.r.l." susceptible to distance selling through the Site are available, with the related product codes, on the Site.

The aforementioned information is provided in accordance with articles 52 and 53 of the Consumer Code.

4. Use of the trademark

The use of the manufacturer's trademark is aimed solely at identifying the destination of the product as an accessory or spare parts but does not in any way indicate the origin of the product itself, which is our exclusive design and manufacture.

5. Price

All prices are expressed in Euros.

6. Order of Products

The essential characteristics and prices of the Products are shown in the offer relating to each Product.

To purchase the Products, the Customer must complete and send Truckdanet s.r.l. the order form in electronic format, following the instructions contained on the Site.

The Customer must put the Product in the appropriate "cart" and, after having read the General Conditions, with particular reference to the contribution for delivery costs and the methods of exercising the right of withdrawal, and the Privacy Policy, must select the desired payment method and choose the option "send order".

By sending the order, the Customer acknowledges and declares to have read all the information provided to him during the purchase procedure and to fully accept the General Conditions.

The Customer will have the opportunity to view and follow the status of his order through the "Orders" area of ​​his account.

Truckdanet s.r.l. reserves the right to evaluate the acceptance of orders received. Truckdanet s.r.l. will notify the Customer of any inability to accept orders received within 30 days from the day following that on which the Customer sent the order to Truckdanet s.r.l. and will refund any sums already paid by the Customer for the payment of the supply.

If the only available sales option is a request for a quote, the customer will follow the same procedure for placing the products in the cart, but will in no case be bound to purchase once the commercial offer has been received.

7. Methods of payment

The Customer may pay the price of the Products and the related delivery costs by Paypal, credit card and by bank transfer (for the latter within seven days).

Truckdanet s.r.l. accepts payments made with the following credit cards:

The transaction will be charged to the Customer's credit card only after that

8. Conferma di ricezione dell'ordine

In conformità a quanto disposto all’art. 53 del Codice del Consumo, il Cliente riceve, al momento dell’esecuzione del contratto, a mezzo email, la conferma di ricezione dell’ordine di acquisto inviato dal Cliente, contenente un riepilogo delle Condizioni Generali, delle caratteristiche essenziali del prodotto ordinato, del suo prezzo, dell’importo pagato, dell’esistenza del diritto di recesso – con l’indicazione dei tempi e delle modalità per la restituzione del bene – dell’indirizzo geografico per presentare eventuali reclami e delle informazioni sui servizi di assistenza e sulle garanzie commerciali esistenti di vendita viene automaticamente annullato e la vendita automaticamente cancellata.

9. Inefficacia dell'ordine

Nessun contratto deve intendersi concluso tra Truckdanet s.r.l. e il Cliente qualora Truckdanet s.r.l. abbia fondati motivi di ritenere che il Cliente non operi in base ad un effettivo e genuino interesse all’acquisto dei prodotti ordinati, o eserciti in maniera abusiva il diritto di recesso riconosciuto dall’art.12 che segue.

In tali casi, l’ordine inoltrato dal Cliente deve intendersi privo di efficacia alcuna. Truckdanet s.r.l. provvederà a trasmettere al Cliente, a mezzo e-mail, una comunicazione attestante la mancata conclusione del Contratto, curando altresì l'immediato rimborso degli importi versati dal Cliente relativi all'ordine. 

10. Trasporto e consegna

At the time of delivery, the signature of an adult over 18 years of age will be required. No deliveries will be made to post office boxes.

For each order placed on the Site, Truckdanet s.r.l. issues an invoice for the goods shipped, sending it by e-mail or post to the holder of the order, pursuant to Presidential Decree 445/2000 and of Legislative Decree 52/2004. For the issuance of the invoice, the information provided by the Customer at the time of the order is valid. No change in the invoice will be possible after it has been issued.

If there are delivery costs charged to the Customer, they will be highlighted on the Site and in the order form.

All purchases will be delivered by express courier chosen by Truckdanet s.r.l. (hereinafter, "Courier") from Monday to Friday, excluding holidays and national holidays. Truckdanet s.r.l. is not responsible for unforeseeable delays (eg strikes).

Truckdanet s.r.l. will send the Customer a confirmation e-mail once the Products have been shipped, in which the tracking number of the shipment will be specified, through which it will be possible to view, after entering the courier's website, the status of the shipment.

In any case, except in cases of force majeure or unforeseeable circumstances, in accordance with the Consumer Code, the Products will be delivered within a maximum period of 30 (thirty) days from the day following that in which the Customer sent the order. to Truckdanet srl, except Truckdanet srl does not communicate - within the same period, by e-mail - the impossibility of delivering the ordered goods following the unavailability, even temporary, of the Products. In the event of such communication, Truckdanet s.r.l. will refund any sums already paid by the Customer for the payment of the supply.

In the event that, following the communication from Truckdanet s.r.l. of a delay in the delivery date, the Customer wishes to cancel the Order, any amount already paid by the same will be refunded as soon as possible, and in any case no later than 30 (thirty) days from the day following that on which the Customer has sent the order to Truckdanet srl and comqunue based on the timing of the payment method used for the purchase by the customer.

For the delivery of the goods, the presence of the Customer or his representative at the address of the recipient indicated in the order is required. Upon delivery of the goods by the Courier, the Customer is required to check that the number of packages delivered corresponds to what is indicated in the transport document and that the package is intact or not altered. Any damage to the package and / or the Products or the mismatch in the number of packages must be immediately notified by means of a written check on the Courier's proof of delivery. Once the Courier's document has been signed, the Customer will not be able to make any objection about the external characteristics of the package delivered.

11. Right of withdrawal

Truckdanet s.r.l. wishes to ensure complete customer satisfaction.

Pursuant to Article 64 of the Consumer Code, the Customer has the right to withdraw from the contract, without specifying the reason, by returning the Products purchased through the Site within 14 (fourteen) working days from the date of receipt of the Products. .

To exercise the right of withdrawal, the Customer must send a communication to the following address: info@truckdanet.it containing:

1. the manifestation of the will to make use of the right of withdrawal pursuant to art. 64 of the Consumer Code;
2. the indication of the Products for which the Customer wishes to make use of the right of withdrawal;
3. the progressive order number issued at the time of purchase;
4. data relating to the customer's bank account, only if the customer has made the payment by bank transfer.
5. his communication can be sent, again within the aforementioned term of 14 (fourteen) days by e-mail.

In case of exercising the right of withdrawal, Truckdanet s.r.l. will reimburse the full price of the Products as long as they are returned by the Customer in a normal state of conservation and packaging and only if the above return instructions are correctly observed. Truckdanet s.r.l. reserves the right to refuse the return of those Products that do not comply with these requirements. Refunds will be made with the same payment method used for the purchase.

For Italy, the delivery costs for returning the Products are borne by Truckdanet; the costs of delivery and return in Europe are charged to the customer.

Each delivery will contain easy instructions for the return of the Products.

Truckdanet s.r.l. undertakes to promptly reimburse the Customer no later than 30 days from the date of the return of the Products. Truckdanet s.r.l. will send an e-mail confirming the refund.

Truckdanet s.r.l. will not be responsible for reimbursement or compensation relating to Products returned but which have never been received by Truckdanet s.r.l. due to loss, theft or damage that are not attributable to Truckdanet s.r.l ..

If the Customer wishes to modify or cancel the order presented, he must promptly send an e-mail to info@truckdanet.com. Once the Product has been shipped, the order cannot be canceled or modified until the shipped goods have been returned to Truckdanet s.r.l .. In this case, reference is made to the returns policy described above.

12. Lack of conformity

In case of lack of conformity of Products sold by Truckdanet s.r.l., the Customer must immediately contact Truckdanet s.r.l. to the email address info@truckdanet.com of Truckdanet s.r.l ..

The legal guarantees provided for in articles 129, 130 and 132 of the Consumer Code apply to the sale of the Products. The Customer has the right to restore, without charge, the conformity of the goods by repair or replacement or to terminate the contract. The Customer loses these rights if he does not report to Truckdanet s.r.l. the lack of conformity within 14 (fourteen) days from the date of receipt of the order.

However, the complete absence of errors cannot be guaranteed.

Truckdanet s.r.l. reserves the right to correct errors, inaccuracies or omissions even after an order has been sent and also to change or update information at any time without prior notice

14. Applicable law and competent court

These General Conditions are governed by Italian law and must be interpreted in accordance with Italian law.

For disputes arising from the interpretation, validity and / or execution of these General Conditions, the mandatory territorial jurisdiction will be that of the court of the Court of Como.
